CERTIORARI TO THE CIRCUIT COURT OF APPEALS
FOR THE SECOND CIRCUIT
Syllabus
1. The ownership of a registered trademark consisting of a name designating the owner’s goods does not carry with it the right to prohibit a purchaser, who repacks and sells them with or without added ingredients, from using the name on his own labels to show the true relation of the trademarked product to the article he offers, provided the name be not so printed or otherwise used as to deceive the public. 2. In this regard, no new right under the trademark can be evoked from the fact that the goods are peculiarly liable to be spoilt or adulterated. P. 369.
