United States v. Shirey, 359 U.S. 255 (1959)

United States v. Shirey

No. 72

Argued January 19, 1959
Decided April 20, 1959
359 U.S. 255

APPEAL FROM THE UNITED STATES DISTRICT COURT
FOR THE MIDDLE DISTRICT OF PENNSYLVANIA

Alleging that he had offered to a Congressman to donate $1,000 a year to the Republican Party if the Congressman would use his influence to procure for him a certain postmastership, an information was filed in a Federal District Court charging appellee with a violation of 18 U.S.C. § 214, which provides that,

Whoever . . . offers or promises any money or thing of value, to any person, firm or corporation in consideration of the use or promise to use any influence to procure any appointive office or place under the United States for any person

shall be fined or imprisoned, or both.

Held: the information states facts sufficient to constitute an offense under the statute, since the word "person" is broad enough to include the Republican Party, and the legislative history of the statute shows that it was intended to cover cases such as that alleged. Pp. 255-262.

168 F.Supp. 382 reversed.
